San Francisco (AP) – A federal judge stopped on Monday from the Trump administration plans to end the temporary legal protection for hundreds of thousands of Venezuelan, a week before its expiration date.

The matter issued by the American boycott judge, Edward Chen in San Francisco, is a satisfaction of 350,000 Venezuelane, his temporary reserve status, which was appointed on April 7, was appointed after the Minister of Internal Security, Christie, reflected the protection granted by the Biden administration.

Chen said in his ruling that the action that Nayyu had “threatens: to inflict damage to hundreds of thousands of people whose lives and families will be disrupted and their livelihoods strongly, and the United States costs billions of economic activity, and public health and safety in societies throughout the United States.”

He said that the government has failed to determine any “real harm to combating talismans in the continuation of TPS for the beneficiaries of the Venezuelan” and said most likely that the prosecutors will succeed in showing that Nayyu’s actions “are not authorized under the law, arbitrary and volatile, and defended by the unconstitutional animation.”

Chen, who was appointed to the bench by President Barack Obama, a democrat, said his order in the lawsuit filed by the National Alliance TPS applies at the national level. Naim also announced the end of the TPS of an additional 250,000 Venezuele in September.

The judge gave the government one week to make a single -week appeal and prosecutors to submit him to 500,000 Haitians who ended TPS protection in August. Alejandro Mayorkas, the former secretary, extended protection for all three regiments until 2026.

“Today is a good day for the migrant community in this country,” said Pablo Alvorado, the co -executive director of the workers ’organization on the National Day.

He said that the people who flee from the Silvador who were tweeted by the war who initially benefited from the TPS program fought to maintain the protection that has become countries such as Ukraine, Sudan and Syria-and the broader society must continue to fight.

“It takes a lot of courage to progress and say:” I am here, and I will fight for this. “We will not throw anyone under the bus. We will fight for everyone because everyone deserves. “

The Ministry of Internal Security did not immediately respond to a request for comment.

The Congress, as it is known for the law, was established in 1990 to prevent deportations to countries with natural disasters or civil conflict, giving people a license to live and work in the United States with an increase of 18 months if the Minister of Internal Security sees that the conditions of their countries are not safe to return.

The repercussions are the main immigration policies during the era of former President Joe Biden, a democratic, and it comes as President of Donald Trump and his highest attacks on the judges who rule against them, with a migration at the forefront of many differences.

In a hearing on Monday, TPS Lawyers said that Noem had no authority to cancel protection and that her actions were partially driven by racism. They asked the judge to stop niam orders, referring to the irreparable damage to TPS holders who struggle with fear of deportation and possible separation from family members.

Government lawyers told Noem that Congress gave the minister clear and wide power to make decisions related to TPS and that decisions are not subject to judicial review. They said that the plaintiffs have no right to thwart the minister’s orders from their implementation.

But Chen found the government’s arguments unconvincing and said that many of the humiliating and sermon comments by Naim – and Trump – against the Venezuelan, as criminals show that the racist Animus was an incentive to end protection.

“The behavior of the negative collective stereotypes and the generalization of such a stereotype of the entire group is the classic example of racism.”

Biden acutely expanded the use of TPS and other temporary protection forms in a strategy to create and expand legal paths to live in the United States while hanging asylum for those who enter illegally.

Trump asked about the neutrality of a federal judge who prevented his plans to deport Venezuelan immigrants to El Salvador, where he just settled his cash hours before his administration request from the Court of Appeal to submit the judge’s order.

The administration also said that it was abolishing temporary protection for more than 530,000 Cubans, Haitians, Nicaragua and Venezuelan who came to the United States since October 2022 through another legal means called the human conditional release, which Biden used more than any other president. Their work permits will end for two years on April 24.
