The Delhi Supreme Court issued notifications of the food delivery giant Zomato and the Competition Committee in India (CCI) amid a continuous achievement to combat monopoly.
The notifications were defended by an appeal from the National Association of Restaurants in India (NRI), which competes with its exclusion from a secret episode of an integral part of the investigation.
The secrecy episode was created in 2022 to protect sensitive information while allowing fair defense between the parties concerned.
Initially, NRI found the same as CCI in October 2024.
The association claims that this exclusion undermines its ability to defend itself effectively and called for the judicial review of the requests of secrecy in Zomato.
In court, Zomato’s lawyer defended the removal of NRI, saying that the association represents competing companies.
Judge Sashin Data, who heads the case, united NRI’s call with a similar case that includes Swiggy, with the next session that was identified on April 23.
This court procedure coincides with the CCI decision, which found that the Zomato platform and the delivery fees did not amount to the abuse of the dominant market.
This represents a development of Zomato, which has been scrutinized for nearly two years.
The original complaint of NRI accused the FoodTec platforms of anti -competition practices, including deep discount, combined services, high commission prices, delayed payments, and imposing unilateral contractual conditions on restaurants.
In April 2024, NRI gave limited access to the results of the CCI investigation under the secrecy ring.
However, Zomato and Swigy competed for this in the Karnataka Supreme Court, noting “irreplaceable commercial damage” from detecting sensitive information.
The court’s decision in June 2024 CCI led to the reassessment and exclusion of NRI at the end of the secrecy episode in October 2024, prompting the association to an erection request in the Delhi Supreme Court.
Earlier this year, NRI also thought about separate legal measures against platforms, highlighting the increasing tensions between the restaurant industry and food delivery services.
